These Terms of Service ("Terms") govern your access to and use of myproprime.com (the "Site") and your purchase of products from RBH Trade LLC, a California limited liability company doing business as ProPrime ("ProPrime," "we," "us," or "our"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority in your state, to place an order. By ordering, you represent that you meet this requirement and that the payment information you provide is accurate and that you are authorized to use it.

2. Products, Pricing, and Promotions

We make every effort to display our products and prices accurately. All prices are in U.S. dollars and exclude applicable sales tax, which is calculated at checkout. We reserve the right to correct pricing or product errors, to limit quantities, and to refuse or cancel any order, including orders placed at an incorrect price, in which case we will notify you and issue a full refund of any amount charged. Promotional pricing, including launch pricing and quantity discounts, is available for the period stated and may be modified or withdrawn at any time without notice. Comparison ("regular") prices shown on the Site are the prices at which we offer the product outside of a promotional period.

3. Orders and Payment

Your order is an offer to purchase. We accept it when we send a shipping confirmation. Payment is processed at the time of order through Shopify Payments or the payment provider you select. We may cancel orders we reasonably suspect are fraudulent, placed by resellers in violation of these Terms, or otherwise in violation of law.

4. Shipping, Returns, and Refunds

Shipping and returns are governed by our Shipping Policy and Return & Refund Policy, which are incorporated into these Terms.

5. Product Information

Our t-shirts are made of 100% cotton. Garment measurements listed in our Size Guide are approximate and may vary slightly. Colors may appear differently depending on your screen. Product images are for illustration.

6. Intellectual Property

PROPRIME, the ProPrime "P" logo, and all content on the Site, including text, graphics, images, and design, are owned by or licensed to RBH Trade LLC and are protected by U.S. and international trademark and copyright laws. You may not copy, reproduce, distribute, or create derivative works from any Site content, or use our trademarks, without our prior written permission.

7. Acceptable Use

You agree not to use the Site for any unlawful purpose; to interfere with the Site's operation or security; to scrape, crawl, or harvest data from the Site; to submit false or misleading information; or to infringe the rights of others. Product reviews you submit must be honest, based on your own experience, and must not contain unlawful or offensive content. By submitting a review, you grant us a non-exclusive, royalty-free, perpetual license to use it.

8. Communications

By providing your email address or phone number and opting in, you consent to receive order-related messages and, where you have opted in, marketing messages from ProPrime. You may unsubscribe at any time using the link in any marketing email or by replying STOP to any text message. Message and data rates may apply.

9. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Site and the products are provided "as is" and "as available," and we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some states, including California, do not allow the exclusion of certain implied warranties, so some of the above exclusions may not apply to you. Nothing in these Terms limits any rights you may have under the California Consumer Legal Remedies Act or other applicable consumer protection laws.

10. Limitation of Liability

To the fullest extent permitted by law, RBH Trade LLC and its members, managers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site or purchase of products. Our total liability for any claim relating to an order shall not exceed the amount you paid for that order. Some jurisdictions do not allow these limitations, in which case they apply to the maximum extent permitted.

11. Indemnification

You agree to indemnify and hold harmless RBH Trade LLC and its affiliates from any claims, damages, losses, and expenses, including reasonable attorneys' fees, arising from your violation of these Terms or your misuse of the Site.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms, the Site, or a purchase shall be brought exclusively in the state or federal courts located in Yolo County, California, and you consent to the personal jurisdiction of those courts. Nothing in this section prevents you from bringing a claim in small claims court where eligible.

13. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top shows when changes were made. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

14. Severability and Entire Agreement

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, constitute the entire agreement between you and RBH Trade LLC regarding the Site and your purchases.
